These Terms govern your use of ritecontrol.com, HMI Editor, and HMI Viewer (the “Services”), operated by Rite Control LLC. By accessing or using the Services, you agree to these Terms.
1. Use of the Services
The Services are provided for lawful business, industrial, educational, and personal use. You agree to comply with applicable laws, regulations, and industry safety requirements.
You may not use the Services unlawfully; disrupt them; attempt unauthorized access; copy, modify, reverse engineer, distribute, sell, or lease them except as permitted by law; or use them in a way that could damage the Services or others’ use.
2. No guarantee of fitness for critical use
The Services are general-purpose software tools. You are responsible for determining whether they are appropriate for your application. They are not guaranteed for life-safety, emergency, medical, hazardous, or other uses where failure, delay, inaccuracy, or interruption could cause injury, death, property damage, or environmental harm.
You are responsible for appropriate safeguards, alarms, interlocks, fail-safe systems, supervision, and testing in every real-world deployment.
3. User responsibility
You are responsible for your configurations, projects, files, settings, backups, and for verifying the accuracy and suitability of displays, outputs, and control logic. Rite Control is not responsible for losses caused by user error, configuration mistakes, network failures, third-party hardware or software failures, or improper use.
4. Intellectual property
The Services and their software, design, text, graphics, logos, and other content are owned by or licensed to Rite Control LLC and protected by applicable law. These Terms grant a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. You retain ownership of project files and content you create to the extent you own them.
5. Website content and third-party services
Website content is provided for general information. We make reasonable efforts to keep it accurate but do not guarantee it is complete, accurate, or current. We may change or remove content and features without notice. Third-party products and services are governed by their own terms, and Rite Control is not responsible for their content, availability, policies, or performance.
6. Privacy
Your use of the Services is also governed by our Privacy Policy.
7. Disclaimer of warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind. Rite Control disclaims implied warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and uninterrupted operation.
8. Limitation of liability
To the fullest extent permitted by law, Rite Control LLC and its owners, officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, business, goodwill, data, or use arising from the Services.
Total liability for any claim will not exceed the greater of the amount paid to Rite Control for the applicable Service in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Rite Control LLC and its affiliates, officers, employees, and service providers against claims, liabilities, damages, losses, and expenses arising from your use or misuse of the Services, violation of these Terms or law, infringement of third-party rights, or any system, equipment, or process you connect to or control.
10. Termination and survival
We may suspend or terminate access if we believe these Terms were violated or action is needed to protect the Services, users, or our rights. Provisions that by their nature should survive termination will survive.
11. App Store terms
If you download HMI Editor or HMI Viewer through the Apple App Store, Apple is not responsible for the Services, their content, support, maintenance, or related claims except as required by law. Your use must comply with applicable App Store rules.
12. Changes and governing law
Updated Terms will be posted here with a revised effective date. Continued use after an update constitutes acceptance. These Terms are governed by the laws of North Dakota, without regard to conflict-of-law principles, except where federal law applies.
